Terms of Service

These Terms of Service ("Terms") govern your use of the AiGentcy platform operated by Better Tomorrow Films LLC ("we," "us," "our"). By creating an account or using AiGentcy, you agree to these Terms.

1. Service Description

AiGentcy is an AI-powered marketing platform that uses specialized AI agents to research, create, schedule, and optimize marketing campaigns for your brand. The service includes campaign generation, content creation, social media scheduling, analytics, and related features.

2. Account

To use AiGentcy, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account.

3. Subscription & Billing

AiGentcy is a recurring subscription service billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are issued for partial months
• Creation credits included in your plan do not expire while your subscription is active but are non-refundable
• Additional credit packs can be purchased separately

4. Founding Members

The first 500 members to subscribe are designated Founding Members and receive:

• First month free on any plan
• Locked founding pricing for life, as long as the subscription remains active

If a Founding Member cancels their subscription, founding pricing is permanently forfeited. Re-subscribing after cancellation will be at standard pricing.

5. Content Ownership

You own all content generated by AiGentcy for your campaigns, including hooks, scripts, social posts, calendar plans, and strategy documents. We retain no rights to your campaign content.

You grant us a limited license to process your data (URLs, brand information, briefs) solely to provide the service. This license terminates when you delete your account.

6. Acceptable Use

You agree not to use AiGentcy to:

• Create or distribute illegal, harmful, or misleading content
• Generate spam or unsolicited commercial messages
• Produce content that harasses, threatens, or defames any person
• Create misleading or deceptive advertising
• Attempt to reverse-engineer, decompile, or extract the AI agents or their configurations
• Exceed rate limits, abuse API access, or interfere with the service
• Resell or redistribute the service without written permission

7. AI-Generated Content

Campaign content is generated by AI agents and may require human review before publication. You are responsible for reviewing and approving all content before it is published to any platform.

AiGentcy is not liable for AI-generated content that you approve and publish. While our quality engine scores and refines all output, AI-generated content may occasionally contain inaccuracies, and final editorial judgment rests with you.

8. Third-Party Platforms

When you connect social media accounts (Twitter/X, Instagram, Facebook, etc.), you must comply with those platforms' terms of service. We act on your behalf when posting content you have approved.

We are not responsible for actions taken by third-party platforms, including account suspensions, content removals, or policy changes that affect your campaigns.

9. Limitation of Liability

The AiGentcy service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, revenue, data, or business opportunities
• Our total liability for any claims arising from your use of the service is limited to the fees you paid us in the 12 months preceding the claim

10. Termination

We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

You may terminate your account at any time through your account settings or by emailing [email protected].

Upon termination, your data is deleted within 30 days. Campaign content you have exported or published remains yours.

11. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes arising from these Terms or your use of AiGentcy shall be resolved in the courts of Los Angeles County, California.
